Terms of Service

By accessing and using Töötaminuga OÜ services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

1. Definitions

Platform Terms

  • Platform: The Töötaminuga website operated by Töötaminuga OÜ.
  • Services: Cleaning services provided through our platform, including Regular cleaning and Deep cleaning services.
  • User: Anyone who accesses or uses our platform, including both clients and cleaners.

User Types

  • Client: A person who books cleaning services through the platform.
  • Cleaner: A service provider who offers cleaning services through the platform.
  • Booking: A scheduled cleaning service appointment created through the platform.

2. Service Description

Töötaminuga is a marketplace platform that connects clients with service providers in Estonia. We facilitate the booking and management of cleaning services but do not directly provide the cleaning services ourselves.

Our Role

  • Facilitate connections between clients and service providers
  • Manage bookings and coordinate payment processing through third-party payment providers (such as Stripe)
  • Provide customer support and handle service-related dispute resolution (payment disputes are handled by the payment processor)
  • Maintain platform functionality and security

Service Types

  • Regular Cleaning: Standard cleaning services for routine maintenance of residential properties
  • Deep Cleaning: Intensive cleaning services for thorough cleaning of all areas, including hard-to-reach spaces
  • Services may be booked as one-time appointments or recurring bookings

Our services are available throughout Estonia. The platform acts as an intermediary and is not a party to the service agreement between clients and cleaners.

3. Account Registration

To use our platform, you must create an account and provide accurate, current, and complete information.

Required Information

  • First name and surname
  • Valid email address
  • Phone number
  • Date of birth
  • Secure password

Account Requirements

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account
  • You must provide accurate and truthful information at all times

Communications and Marketing

By creating an account, you agree to receive communications from us, including:

  • Service-Related Communications: Booking confirmations, service updates, account notifications, and other essential platform communications (these cannot be unsubscribed from as they are necessary for platform operation)
  • Marketing Communications: Periodic marketing emails, promotional offers, service updates, cleaning tips, and other marketing content

Unsubscribe Option:

  • You may unsubscribe from marketing communications at any time by:
    • Clicking the unsubscribe link in any marketing email, OR
    • Adjusting your email preferences in your account settings
  • Unsubscribing from marketing communications will not affect your receipt of essential service-related communications
  • Both clients and service providers may receive marketing communications unless they choose to unsubscribe

We reserve the right to suspend or terminate accounts that provide false, inaccurate, or incomplete information.

Service Provider Registration Requirements

To register as a service provider (cleaner) on our platform, you must meet the following mandatory requirements:

Legal Work Authorization

You must have one of the following:

  • Valid Estonian residence permit with work authorization, OR
  • EU citizenship with right to work in Estonia, OR
  • Any valid form of working permit allowing you to work in Estonia

Tax Compliance

You must have:

  • LHV entrepreneur account (for individual service providers), OR
  • Company bank account (for companies providing services)

Background Check

All service providers must complete a background check as part of the registration and verification process. This is required to ensure platform safety and compliance with our standards.

  • Background checks are conducted as part of the service provider onboarding process
  • You must provide accurate information and cooperate with the background check process
  • We reserve the right to conduct background checks and verify information at any time
  • Failure to complete or pass the background check may result in account rejection or termination

Dashboard Setup Requirements

Before you can receive any bookings on the platform, you must complete the following setup requirements in your service provider dashboard:

  • Bank Account Details: Link your bank account details (LHV entrepreneur account for individuals or company bank account for companies) to receive payments
  • Location: Set your service location and service area to appear in client searches
  • Rates: Set your hourly rates for each service type you offer (Regular cleaning and/or Deep cleaning)
  • Availability: Set your availability schedule indicating when you are available to accept bookings
  • Profile Information: Complete your profile with accurate information, including languages spoken, expertise areas, and service descriptions

Important: You will not receive any booking requests until all required dashboard setup steps are completed and verified. Incomplete profiles may result in delayed account activation or suspension.

Important: No individual without proper work authorization is permitted to work on our platform, as this would breach Estonian employment and immigration laws. We reserve the right to verify these requirements and terminate accounts that do not comply.

4. User Responsibilities

Client Responsibilities

  • Provide accurate contact information and service address
  • Ensure safe and accessible entry to the property for cleaners
  • Provide cleaning supplies and materials for service providers to use during the cleaning service
  • Pay for services as agreed upon booking
  • Treat cleaners with respect and maintain a professional environment
  • Report any issues or concerns within 24 hours of service completion
  • Ensure the property is safe and free from hazards that may endanger cleaners

Cleaner Responsibilities

  • Provide professional, high-quality cleaning services as described
  • Arrive on time and complete work within the scheduled time frame
  • Maintain professional conduct and respect client property at all times
  • Carry appropriate insurance (cleaners are responsible for their own insurance as the platform does not provide insurance coverage) and follow all safety protocols
  • Use only approved cleaning products and methods as agreed with the client
  • Report any property damage or issues discovered during service immediately
  • Maintain confidentiality regarding client information and property details

5. Booking Process

The booking process consists of the following steps:

  1. Service Selection: Select the type of cleaning service (Regular or Deep cleaning) and specify the number of hours required
  2. Location Entry: Enter your postal code to find available cleaners in your area
  3. Cleaner Selection: Browse available cleaners, review their profiles, ratings, and rates, then select a cleaner
  4. Authentication: Sign in to your account or create a new account if you do not have one
  5. Address Confirmation: Confirm your full service address, including apartment number if applicable
  6. Date and Time Selection: Choose your preferred service date and time from available slots
  7. Review and Payment: Review your booking details and complete payment to confirm the booking

Once a booking is confirmed, you will receive a confirmation email with booking details. The cleaner will be notified and may accept or reject the booking. If rejected, you will be notified and may select another cleaner.

6. Payment Terms

Payment Requirements

  • Payment is required in full before the service commences
  • All payments are processed through secure third-party payment providers (such as Stripe). We do not directly process payments.
  • We accept major credit cards, debit cards, and Estonian bank transfers
  • Payment must be completed to confirm and secure your booking

Pricing Structure

  • Service prices are based on the cleaner's hourly rate, multiplied by the number of hours booked
  • Prices may vary based on location, time of day, apartment size, and other factors
  • A service fee (typically 2-3% of the total price) is applied to cover platform operations
  • Distance-based fees may apply for cleaners traveling beyond a certain radius
  • All prices displayed on the platform are final and include all applicable fees
  • Additional charges for extra services must be agreed upon between the client and cleaner before service commencement

Refund Processing

  • Refunds, when applicable, will be processed according to our cancellation and refund policy
  • Refunds are typically processed within 5-10 business days after approval
  • Refunds will be issued to the original payment method used for the booking

Service Provider Payments

  • Service providers are paid on a weekly basis for completed bookings
  • Payments are processed each Monday of a new week, provided it is not a public holiday
  • If Monday falls on a public holiday, payments will be processed on the next business day
  • Payments are transferred to the bank account details linked in your service provider dashboard
  • You must have valid bank account details linked in your dashboard to receive payments
  • The platform charges service providers a commission of 15% of the original payment made by the client for each completed service
  • The commission is deducted from the service provider's earnings before payment is processed

7. Cancellation and Refund Policy

Cancellation by Client

  • More than 24 hours before service: Free cancellation with full refund
  • Within 24 hours of service: 50% of the total booking amount will be charged as a cancellation fee
  • Same-day cancellation: No refund will be provided
  • Cancellations must be made through your account dashboard or by contacting customer support

Cancellation by Cleaner

  • If a cleaner cancels a booking, you will receive a full refund of all amounts paid
  • We will make every effort to find an alternative cleaner for your scheduled time
  • If an alternative cleaner cannot be found, the service will be rescheduled at no additional cost
  • You will be notified immediately if a cleaner cancels your booking

Refund Processing

  • Approved refunds are processed within 5-10 business days
  • Refunds are issued to the original payment method used for the booking
  • Processing times may vary depending on your payment provider

8. Service Quality and Satisfaction

We strive to ensure high-quality cleaning services through our platform. However, as an intermediary, we do not directly control the quality of services provided by individual cleaners.

Quality Expectations

  • Cleaners are expected to provide professional, thorough cleaning services as described
  • Services should be completed within the scheduled time frame
  • Cleaners should use appropriate cleaning products and methods

Satisfaction Guarantee

  • If you are not satisfied with the service quality, you must report the issue within 24 hours of service completion
  • We will investigate the issue and may arrange for a re-cleaning at no additional cost
  • In cases of significant service failure, we may provide a partial or full refund at our discretion
  • Satisfaction claims must be supported by evidence such as photos or detailed descriptions

Dispute Resolution

  • We provide dispute resolution services for service quality issues between clients and service providers
  • Payment disputes (chargebacks, refunds) are handled by the payment processor (such as Stripe) according to their terms
  • Service-related disputes should be reported through your account dashboard or by contacting customer support
  • We will review service disputes and make decisions based on available evidence and platform policies
  • Our decisions regarding service disputes are final, but we strive to be fair and reasonable in all cases

9. Limitation of Liability

Töötaminuga OÜ acts as an intermediary platform connecting clients with cleaners. We are not a party to the service agreement between clients and cleaners.

Our Limitations

  • We do not guarantee the quality, safety, or outcome of individual cleaning services
  • We are not liable for any damage to property that occurs during or as a result of cleaning services
  • We are not responsible for the actions, omissions, or conduct of individual cleaners or clients
  • Our liability is limited to the amount you paid for the specific service in question
  • We are not liable for any indirect, incidental, or consequential damages
  • We provide dispute resolution services for service quality issues, but payment disputes are handled by the payment processor. We are not responsible for the outcomes of payment disputes.

Cleaner Liability

Cleaners are independent service providers and are responsible for their own insurance (the platform does not provide insurance coverage), taxes, and compliance with applicable laws.

10. Intellectual Property

All content on the platform, including text, graphics, logos, images, and software, is the property of Töötaminuga OÜ or its licensors and is protected by Estonian and international copyright and trademark laws.

Platform Ownership

  • You may not copy, reproduce, distribute, or create derivative works from any platform content without our express written permission
  • The Töötaminuga name and logo are trademarks of Töötaminuga OÜ
  • Unauthorized use of our trademarks is prohibited and may result in legal action

User Content

  • You retain ownership of any content you submit to the platform (reviews, photos, etc.)
  • By submitting content, you grant us a license to use, display, and distribute that content on the platform
  • You are responsible for ensuring you have the right to submit any content you provide

Third-Party Content

Some images and visual content used on the platform are sourced from Pexels.com under their open source license. These images are used in accordance with Pexels' licensing terms. Users should respect the licensing terms of all third-party content used on the platform.

11. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Fraudulent activities, including providing false information or misrepresenting your identity
  • Harassment, abuse, or discrimination toward other users or platform staff
  • Attempting to circumvent platform fees or payment systems
  • Unauthorized access to other users' accounts or platform systems
  • Sharing your account credentials with others or allowing others to use your account
  • Soliciting or accepting payments outside of the platform for services booked through the platform
  • Posting false, misleading, or defamatory reviews or content
  • Using the platform for any illegal purpose or in violation of applicable laws
  • Interfering with or disrupting the platform's operation or security
  • Reverse engineering, decompiling, or attempting to extract the source code of the platform

Violation of these prohibitions may result in immediate account termination and legal action.

12. Termination

Termination by Platform

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of the platform or other users
  • Non-payment of fees or charges
  • Any other reason we deem necessary to protect the platform

Termination by User

You may close your account at any time through your account settings or by contacting customer support.

Effect of Termination

  • Upon termination, your right to use the platform immediately ceases
  • Active bookings may be cancelled according to our cancellation policy
  • We may retain your account information as required by law or for legitimate business purposes
  • Provisions of these terms that by their nature should survive termination will remain in effect

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by:

  • Posting the updated terms on the platform
  • Updating the "Last Updated" date at the top of this document
  • Sending email notifications for significant changes

Your continued use of the platform after changes become effective constitutes your acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the platform and close your account.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from or relating to these terms or the platform shall be subject to the exclusive jurisdiction of the courts of Estonia. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such disputes.

15. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.
